Terms and conditions

§ 1 Scope

These terms apply to all orders placed with Max Winkel, Olive Video (“we”). Our offer is aimed exclusively at businesses within the meaning of § 14 of the German Civil Code (BGB), not at consumers. Deviating terms of the customer apply only if we agree to them in writing.

§ 2 Services

From photos that the customer provides or names, we create a video of 45 to 90 seconds in 16:9 and 9:16. The camera moves are generated with AI from the photos; order, editing and review are done by hand. If the customer publishes the video, they label it as made with AI where the law requires it (Art. 50 EU AI Act); on request we add the note “Made with AI”. The video shows the rooms as they appear in the photos. We do not owe a photorealistic depiction of every detail. § 3 Conclusion of contract

The contract is concluded when the customer orders by email (for example with “Yes” to our quote) and we then send the invoice.

§ 4 Prices and payment

The price in our quote for the respective property applies; it depends mainly on the size of the property. As a small business under § 19 of the German VAT Act (UStG) we do not charge VAT. The invoice is payable by bank transfer within 7 days.

§ 5 Delivery

We usually deliver within one to two days of receiving payment, as a download link. For several properties we deliver in stages.

§ 6 Changes and money back

We make requested changes to the delivered video free of charge, for example to the order, texts, music or individual camera moves. Other photos or a different property constitute a new order. If the customer still does not like the video after the changes, we refund the full price on request, provided they declare this within 14 days of delivery. With the refund the right of use (§ 8) ends: the customer deletes the video and does not publish it. If they use it nevertheless, the agreed price becomes due as remuneration for the use.

§ 7 The customer’s photos

The customer warrants that they may use the photos for the creation of the video and have them edited, and confirms this when ordering. They indemnify us against third-party claims based on an infringement of these rights.

§ 8 Rights of use and reference

Upon full payment the customer receives the right, unlimited in time and place, to use the video for marketing the property and their business. We may show the video as a reference unless the customer objects; a short message is sufficient.

§ 9 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body and health. In the case of slight negligence we are liable only for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract and at most to the order value.

§ 10 Final provisions

German law applies. If the customer is a merchant, the place of jurisdiction is our registered office. There is no right of withdrawal, as the offer is aimed exclusively at businesses.
